Is this page relevant to the H264 discussion?
Apparently H264 patents expire on August this year (the most relevant patents on most countries, there may be exceptions). I guess by then things should be a bit easier?

Unfortunately, hardware based decoding in FFmpeg is tied to the native
software decoder, so to enable hardware H.264 playback we would have to
enable built-in h264 decoder and we are not allowed to do that (yet).
